Sierra Leone: On Friday, 30th April, 2021, Moses Santigie Kargbo and Co made their fourth appearance before Magistrate Mark Ngegba of Magistrate Court No. 2 on Pademba Road in Freetown. The five accused are facing a preliminary investigation of alleged Conspiracy to Commit Murder, Murder Contrary to Law and Robbery with Aggravation according to Sections 4 of the Offences Against the Person Act 1861 and 23 (1)(a) of the Larceny Act 1916.
Under Cross examination, Memunatu Kamara, wife of the deceased Mohamed Kamara, agreed with the defense counsel I. S. Y. Kamara representing the first accused Moses Santigie Kargbo that not all the thieves that invaded their home, robbed and killed her husband were in the dock. She said they were having cutlasses and a gun she identified as a pistol. She answered that the first accused known to be a police officer used the gun to shoot her husband. She also responded that the accused forced her to bow her head down.
She told the court that before her husband succumbed to his injuries he told her that it was the accused who attacked them and inflicted the fatal injuries on him. She said the first accused was not wearing a mask to disguise his facial identity. She clarified that among the gang of assailants on their residence, four are in court including the first accused. At this juncture, the witness denied the assertion made by the defense counsel that during the attack on their home the first accused was on duty. She said he was there and took part in the beating and killing of her husband.
Meanwhile, Lawyer J.T. Mansaray representing the second accused, Chernor Sesay, applied for the court to rely on the cross examination of the substantive counsel for his client. The third, fourth, and fifth accused, Ishmail Samura, Michael Kinney Ndanema and Abdul Bombali Kanu were not legally represented but equally asked the witness questions.
In response the witness said she did not identify them in the police Identification parade conducted at Masiaka Police station, nor did she find any of her stolen property in their hands. She also agreed with the accused that they were not arrested in her house where the alleged incidents occurred nor does she know them personally.
The police alleged that the accused on the 12th January, 2021 at Rogbere Junction, in the Mafoki Chiefdom, North West Region, conspired together and with other person’s unknown to commit Murder, Murdered Mohamed Kamara and robbed him off several valuable properties all to the tune of Twenty-four Million Leones, immediately, before and after the act, and did use personal violence on him.
The matter was prosecuted by Inspector A.T. Bangura and adjourned to the 7th May, 2021. DT/02/05/2021
