Khadi Palmer (SLPP Flag bearer aspirant for the 2012 election) was yesterday discharged in court on a one-count charge of larceny by Magistrate J. O. Wellington of Court No.2.
The particulars of offence are that the accused on 10th October, 2010 at 7 Madongo Town, stole one decoder and remote control to the total value of Le 450,000, Property of Wilmot Johnson-Cole.
Three witnesses gave evidence for the prosecution: PW1 the Complainant, PW2 Winstona Johnson-Cole, niece of the Complainant and the Police factual witness.
From the evidence, the accused is the sister-in-law of the complainant Wilmot Johnson – Cole-who went to stay at the family house.
PW2 Winstona Johnson-Cole in her evidence testified that she was in her room when her uncle, the complainant, called her to the parlor. She said he asked her to be a witness as the accused had taken the decoder and the remote and handed them over to a lady that was with her.
Under cross examination, PW2 said she did not see the accused taking the remote and decoder. She said she saw the lady taking the decoder and remote from one bag and put them into another bag. The mysterious lady was never called to give evidence or charged as a receiver.
Magistrate Wellington said that in a criminal matter, the prosecution must prove its case beyond reasonable doubt. Where there is any doubt it must be in favour of the accused.
