Sierra Leone News:Alleged domestic violence…Prosecution and defense battle over bail

On Friday at the Freetown Magistrate Court No.2 in front of Magistrate Albert Moody, police prosecutor inspector Sorie Conteh was in bail battle with defense lawyer J.K Lansana regarding the granting of bail for the accused in an alleged domestic violence matter.
Lawyer J.K Lansana was representing the accused Sallay Pujeh and Hassan Pujeh and he applied for bail for his clients noting that “My lord most respectfully I apply for bail for both accused, they are ordinary residents within the judiciary, your lordship you will agree with me when this matter commence, they came to court on their own, and they will always come to court and be of good behaviour”
He furthered that “for now the charged may be allegation and upon this note, I kindly request your lordship to grant them bail, as they have credible sureties to sign on their behalf” the lawyer averred.
Objecting to bail inspector Sorie Conteh noted that “My lord I am objecting to bail on the grounds that, the offence against the accused is for domestic violence and both parties are living under the same house and there may be a tendency for more controversy if you granted them bail.
He pointed out that “they were engaged in disputes even this morning until we admonished both parties” the inspector said.
After listening to the application made by the defense and the reply made by the prosecutor, Magistrate Moody decided to stood them the matter for some time and later granted both accused bail in the sum of ten million Leones Le(10,000000) each one surety ,who must be a resident of the Freetown municipality and  must have a national identification card.
The first accused Hassan Pujeh was charged with two count of domestic violence contrary to section (2)1 of the domestic violence act of 2007 and the second accused Sally Pujeh was charged with one count of domestic violence.
The particulars of offence stated that Hassan Pujeh and Sallay Pujeh on Sunday 22nd may 2016 at 41 upper Brook Street in Freetown physical abused Idrissa Karim Pujeh with whom the second accused is in domestic relationship with. The matter was adjourned to n Monday 25th July 2016.
