Magistrate Albert Moody of the Freetown Magistrate Court No.2, on Monday found guilty and sentenced the accused Isatu Conteh to three month imprisonment or pay a fine of one hundred thousand Leones (Le150, 000) to the court treasury.
Magistrate Moody maintained that “based on the evidences before the court and the testimonies of witnesses in this matter, the accused is found guilty of both charges.”
The accused was charged by the police with two counts. Count one is for domestic violence contrary to section 2(1) of the domestic violence act of 2007 and count two also is for domestic violence contrary to section 1 of the same act.
After the magistrate had found the accused guilty and prior to the pronouncement of the sentence and fine of the accused, the defense lawyer Abdul Rahman Kamara pleaded with the magistrate to temper justice with mercy. He noted “we accepted the ruling of the honourable court my lord but, I am pleading with you to temper justice with mercy, adding that the accused is a first time offender and I promise that such contest will not be replicated and this judgement will serve as a lesson, we are asking for a fine my lord” the lawyer averred.
Magistrate Albert Moody sentenced the accused to three months imprisonment or he pays a fine of one hundred thousand Leones to the state and four hundred thousand Leones (Le400, 000) as compensation to the complainant Sarah Kamara.
According to the particulars of offence before the court, that Isatu Conteh on Sunday 31st January 2016 at Peacock Farm Wellington in domestic relationship with Sarah Kamara to wit her mother verbally abused her and also on this said date and address psychologically abused her also.
