On 8 March 2016, Daniel S. Turay was arrested for an allegation of attempted murder of Sorie Bangura in Freetown. It is alleged that Turay stabbed Bangura on his back attempting to kill him. The accused pleaded guilty of Attempted Murder. The accused was granted bail of Le100 million after his plea.
Three prosecution witnesses, including the victim, have explained testimony to the Court.
In her submission during the last proceeding, State Prosecution, M.S. Jalloh informed the Court about the complainant’s lack of interest in the matter.
The complainant, Bangura, has failed to attend Court proceedings on consecutive adjournment dates to officially inform the court about his intention.
Justice John Bobsco Allieu, on Monday, ordered a warrant of arrest for the victim.
The order was as a result of the victim’s continuous absence, which according to the judge has delayed the outcome of the matter. Justice Allieu told the court that he cannot discharge the matter without the correct procedure pointing out the need for the complaint’s official declaration of intention in an open Court.
The reason is based on the fact that the allegation is a serious offence and the discharge of the matter without court record might have serious consequences in the future.
“I don’t want to discharge the matter and later something comes up wherein the complainant denies what he has said. Without Court records, it would be hard to challenge such a situation and in case the accused is arrested for any other offence, I don’t want the discharge to be questioned so its therefore essential that the court records the complainant’s decision before discharging the matter.” the Judge stated. Meanwhile, the accused’s bail conditions continue as the matter was adjourned to 29 November 2017.
