Magistrate Emmanuella Harding of court No 6 yesterday refused an application made by Lawyer C.F. Edwards for self bail for the surety of the 2nd defendant, because of the objection raised by the prosecution counsel as to who will be held responsible if the surety failed to appear on the next adjourned date.
The application was based on the court records that the 2nd defendant had been absent for more than two month as indicated in the medical report.
While the matter was mentioned the respondents Mummy T, Mammy Iye, Fatmata Kamara, Sallay Koroma and Abie Sesay were not around, after few minutes they entered the court and Magistrate Harding asked them where they were as they are not treating the court seriously. One of the respondents said they went to call their Lawyer. Magistrate Harding asked them if it is proper for all of them to go and call their lawyer, they replied no.
Lawyer James F. Sesay representing the plaintiff Madam Patricia A. Thomas said the medical report of the 2nd defendant states that she should have bed rest for two months and the period had exceeded.
According to the court records Magistrate Harding said on the last adjourned date the surety for the second defendant failed to produce the 2nd defendant or produce a medical report on her behalf.
Lawyer Edwards said he will ensure that the proper medical report is tendered and applied that the surety be put on self bail.
Lawyer Sesay said he is not objecting that the surety should be put on self bail but if he failed to show up on the next adjourned date who is to blame.
