Football Club (FC) Kallon a premier league team created by Leone Stars Captain Mohamed Kallon may take the Sierra Leone Football Association (SLFA) to the high court presided over by Justice Showers.
Kallon FC decided to take SLFA to because according to them one of their players Alex Sesay who was not properly transferred to Blackpool was fielded against them last year December 9 in the premier league.
Two days later, FC Kallon filed in a protest against the player and paid a protest fee of one hundred thousand Leones. According to them (FC Kallon) they were never informed about the decision taken by appeals committee.
After the premier league, the SLFA decided to declare Ports Authority as champions which did not go down well with the club. “We have nothing against Ports Authority” they said but they want to make sure that SLFA treats the appeals lodged by clubs very serious so that standards in the premier league are maintained.
Responding to the case of FC Kallon the administrative Secretary of the association Abubakarr Kabbah said that FC Kallon never informed them about their decision of taking the SLFA to court to seek an injunction.
He said they could have taken the matter to court if they had failed to solve the matter at all cost. He stated further that according to the SLFA constitution no club has the power to take the association to court. He disclosed that the injunction filed against SLFA was for May 10th 2008.
And he said they have informed the association’s lawyer Jenkins Johnson about the matter and he will appear on behalf of the SLFA in the high court today Wednesday 14th May 2008.
According to article 65 which deals with arbitrations, SLFA shall create an arbitration tribunal which shall deal with all internal disputes between SLFA, its members, players, officials and match players agents that do not fall under the jurisdiction of its judicial bodies.
Furthermore the Executive Committee shall draw up special regulations regarding the composition, judicial and procedural rules of this arbitration tribunal.
He went further to quote article 66 of the same constitution which deals with Jurisdiction. He mentioned that SLFA its members, players, officials and match player agents will not take any dispute to the ordinary courts unless specifically provided for in the statutes and FIFA regulations.
Any disagreement shall be submitted to the jurisdiction of FIFA, CAF or SLFA he said adding that the SLFA shall have jurisdiction on internal disputes i.e. disputes between parties belonging to SLFA.
FIFA shall have jurisdiction on international disputes i.e. disputes between parties belonging to different associations and or confederation
