Three boys aged 16years were on Thursday 12th January arraigned before Magistrate Steven Conteh at Court No 1 on two count charges of conspiracy to commit a crime and burglary. The three who reside at No 9 Dao Road Juba Hill in Freetown, are alleged to have broken into the house of one Salamatu Janneh the complainant to steal properties and physical cash to the tune of Le5,585,000.
The defense lawyer for the first accused Pa-Momoh Fofanah pleaded with the court to grant bail to his client since the boy is under the age of 18 years. He further pleaded that his client is a juvenile and according to the Child Act Law of 2008 a juvenile who commits a crime should be kept at remand home at Kingtom and not Pademba Road.
His plea was objected to by Radcliff A.D Jones the lawyer prosecuting the accused boys. In his argument, Mr Jones pointed out that there was no evidence to prove that the first accused Amidu jonny is a juvenile since there was no record in court to ascertain the claim.
After carefully listening to the arguments on both sides presiding Magistrate Steven Conteh promised to seriously look into the case of the first accused.
He adjourned the matter to the 16th of February, 2009.
