The Supreme Court presided over by Hon. Justice Shiineh Bash-Taqi on Saturday July 9, unanimously overruled Lawyer Charles Margai’s challenge of a ruling at the Justice Edmond Cowan Tribunal.
Charles Margai who is representing Justice Alan Halloway at the Tribunal, had submitted that the Chairman of the Tribunal, Justice Edmond Cowan, and the three Commissioners: Haja Seray Kallay, Wordsworth Filo-Jones and Mr. A.R. Caesar, cannot sit on the Tribunal.
Charles Margai had also submitted that the Commissioners had passed the age to qualify them to sit as Justices of a Superior Court as laid down in the Constitution of Sierra Leone.
Charles Margai had also submitted that the Chairman of the Tribunal being also the Ombudsman of Sierra Leone, must excuse himself to avoid conflict of interest, should Justice Allan Halloway be aggrieved by the Tribunal’s proceedings, decide to petition the office of the Ombudsman.
He further submitted that since the day of the commencement of the Tribunal as published in the Sierra Leone Gazette had passed, the proceedings will be regarded as null and void.
