Justice Samuel Ademusu past Friday turned down an application made by Defense Counsel representing the former Minister of Fisheries and Marine Resources (MFMR) Haja Afsatu Kabba charged with alleged corruption.
The application filed by Lawyer Yada Williams was for the removal of all protective measures of prosecution witnesses in the trial.
The Prosecutor for the Anti Corruption Commission (ACC) Calvin Mantsebo earlier objected to the application and submitted that it was not properly before the court.
Justice Ademusu ruled that the application made by Yada Williams was not properly done and stressed that he will not rule against another High Court ruling.
The Judge stated that the judgement taken in a Judge’s Chamber is equal to a judgement made in an open court.
Technically, he further stated that Yada Williams is not part of the Defense team so therefore the application filed by him is not properly done.
On that basis, witnesses lined up for the case will testify on Monday in camera.
But Yada Williams further argued that the court should allow them to see the witnesses.
It would be recalled that Justice Browne- Marke had made a ruling for prosecution witnesses to testify in camera, but the Defense want this to be removed. The matter will resume this morning.
