Accused Festus Mackey was yesterday arraigned at Magistrate Court No 1 for Assault Injury of his brother Micheal Pipor Fraser a Sierra Leonean based in Maryland the United States of America which took place on the 19th November 2007 at 78 Lumley Road Wilberforce Freetown
The matter was reported to the Congo Cross Police Station but was later transferred to the Lumley Police for further investigations. The Complainant in his cross examination by Inspector Bangura narrated how and when he was assaulted by the defendant during a family meeting that was arranged to discuss matters and work out modalities on fencing and sharing family properties situated at 78/ 79 Lumley Road Wilberforce. He narrated that when the defendant was asked to make his contribution to the meeting he started off with the use of abusive language which aggravated and lead to the physical assault of the complainant.
According to the complainant he sustained serious injuries on his right eye, but managed to halt the heavy punch at the presence of his sisters Fadiliya MacKay, Princess Scott and Olive Sawyer. He was however rushed for medical attention .
During the cross examination a medical report was presented to the court and further hearings have been fixed for 12th February 2008.
