Justice Samuel Ademusu will today give ruling on an application filed by the defence team of the Former Minister of Fisheries and Marine Resources, Haja Afsatu Kabba charged with seven counts of alleged corruption.
The defence made an application to the court for the removal of all protective measures in the trial and was filed by Lawyer Yada Williams.
Objecting to the application, the Prosecuting Counsel, Lawyer Calvin Mantsebo argued that the application is not properly done before the court as it has no legal foundation.
The prosecutor said the Judge has no authority to listen to the defense application because they are getting confused as they are receiving correspondence from Lawyer Jenkins Johnston and Sulaiman Tejan Jalloh and now Yada Williams.
In reply, Yada Williams deliberated lengthy on the issue raised by the Prosecutor and noted that, it was wrong for the prosecutor to equate correspondence between the Anti Corruption Commission (ACC) and Sulaiman Tejan Jalloh.
He further stated that there is no provision in the Act or any other enactment for the Prosecutor to file change of Solicitors in a criminal matter.
Earlier the first Prosecution witness, Abubakarr Jalloh tendered documents showing signatories to the Ministry of Fisheries account.
Tendering the documents, Lawyer Jenkins Johnston asked the witness to name the authorized signatories to the account.
He named Abdul Rahman Sanusi an accountant and Dr Mohamed Batu Duramani Sesay Director of Fisheries as signatories to the account.
Further asked if the accused is a signatory to the account, he replied no.
Lawyer Jenkins Johnston also asked the witness to tendered the Statement of Account of the Ministry from 2001-2010. The witness produced the 11 page Statements and it was tendered as exhibit.
