“I did not retaliate because I trust the law” – soldier testifies

Elvis Daniel Morgan, a soldier for 35 years standing, who was allegedly assaulted by Pastor Joseph Abu Marsh, has on Wednesday 19th August told the court during cross-examination that he did not retaliate when assaulted because he trusts the law. Sergeant Morgan said Pastor Marsh attacked him inside his bedroom, threw his standing fan at him, and threatened to destroy his eyes. “He also confessed that he was responsible for the death of my elder brother, the rightful owner of the house where I reside,” he said. Morgan said he exercised restraint and did not do anything to Pastor Marsh, and reported the matter to the Lumley Police Station, where he was given an endorsed medical form to see a doctor.

Defence counsel, S.T.N Navo made a mockery of the victim, as Morgan who is tall and huge as opposed to Marsh, could not have stood in his room and allowed Marsh to assault him.

In addition, he said, Morgan might have caused the fight as he had closed the gate and Marsh could not gain access to his apartment. He said Morgan was not being truthful with the court when he said Morgan assaulted him but he did not retaliate. In response, Morgan said, “I did not retaliate because I trusted the law, and I do not want to take the law into my hands.”

Police alleged that the accused on Wednesday 8th April 2020 at No.1 Regent Road Lumley maliciously wounded RSLAF 18164003 Elvis Daniel Morgan. The accused Pastor Joseph Abu Marsh is charged with a count of wounding contrary to Section 20 of the Offence Against the Person Act 1861.
