High Court sends Aziz Carew and other to prison

Sierra Leone Peoples Party (SLPP) Constituency 104, Ward 369 Chairman Abdul Aziz Carew and Abdul Quee yesterday 1st February made their first appearance before Justice Browne- Marke at High Court. The accused were charged with the offence of wounding with intent and wounding contrary to section 18 of the offences Against the Persons Act 1861.
The offences are alleged to have taken place in Constituency 104 in Fourah Bay during a Local Council bye-election, on 14th January 2012.
The two accused persons were discharged from Magistrate Court No. 2 where they were facing five counts charge of wounding and charged again after an application by State Prosecutors for the case to be transferred to the High Court for speedy, fair and impartial trial and in the interest of Justice.
According to the application, Aziz Carew was charged on two counts charge of wounding with intent contrary to section 18 of the Offences Against the Persons Act 1861 and against Abdul Quee, one count of wounding.
A warrant of arrest was issued and directed to the Sheriff of the High Court for the apprehension of the said Aziz Carew and Abdul Quee in respect of the said offences.
That warrant of arrest was returned to the High Court on Wednesday 1st February, 2012. The State Prosecutor Gerald Soyei, earlier made an application for the committal of the case to the High Court under section 136 of the Criminal Procedure Act of 1963 which says the Law Officers Department can use this section for sending any case that is on Preliminary Investigation in a Magistrate Court to High Court for speedy trial.
He also made an application for bail not to be granted to the two accused. The application was endorsed and the two were remanded at the Pademba Road Prison. The matter comes up on Wednesday 8th February 2012.
After the application was granted, there was murmuring among supporters of the SLPP. There was also a nerve-wracking moment of howling when the accused were taken down to the court lock up.
One of the Lawyers representing the accused persons is Sulaiman Baja Tejan Sie.
The matter comes up on 8th February 2012.
