For Police negligence – 2 discharged

Magistrate Tonia Nbawa yesterday discharged Ali Badara and Abubakarr Conteh due to the negligence of the police.
The accused were charged with 3 counts of threatening remarks, conspiring to destroy growing plants and the destruction of four mango trees costing Le1million and two palm trees costing Le500,000 and malicious damage.
The accused pleaded not guilty.
Lawyer A.K Musa for the accused objected on count two that there was no offence stipulating section 19 of the malicious damage act.
He pleaded that the accused persons be discharged of count two because the charge was improper. The Defense lawyer also said the charge was crucial and cannot be amended.
Sgt. 721 Conteh S. prosecuting objected to his application but Magistrate Tonia Nbawa said because of the negligence of the police she was discharging the accused persons off the second count whilst granting them bail on the 1st and 3rd count charges respectively.
