The Military Court Martial at Cockerel of RSLAF 18181375 Kekula Johansoon aka Abdul Sesay for the alleged murder of Private Mohamed Jongopee RSLAF 1818371 at Kabala on 22, February, 2009 yesterday resumed hearing since it was adjourned on the 11th March 2009.
The presiding Judge Advocate Justice Ademusu was flanked by Board Members of the court including the President of the court Lt Commander D S Mansaray while the prosecution team was lead by F Ngevao and the defense team lead by Mr.A Macaulay.
The trial was observed by IMMATT Legal advisers and a visiting team from the US Marine Legal team and a cross section of soldiers and the public. The defense Minister Paolo Conteh briefly stopped by to meet court officials.
The lead Prosecutor F Ngevao made an application on the grounds that prior to the arrest of the accused he had used a DDR ID Card bearing the name of Kekula Johansson to get enlisted into the Army which was not his actual name. He told the court that his actual name is Abdul Sesay and the charge sheet should bear that name. The application was granted by the court.
The prosecutor also told the court that 10 witnesses are ready to testify in the course of the trial. The defense team also told the court that they have two witnesses to testify. The defense team also told the court that, they are yet to see the post mortem results from the pathologist.
After a brief adjournment the lead prosecutor read his findings and told the court that the accused committed an alleged murder contrary to law as the offence attracts death penalty when found guilty.
A prosecution witness RSLAF/18180908 Joanna Bockarie a (tailor) said in evidence that one Mbalu wife of the deceased and Kadi wife of the accused had quarrelled and were pelting each other with stones. .
He also told the court that in the early hours of 23 /2/ 09 he heard someone screaming and shouting that he had been stabbed. He rushed to the guard post and saw the deceased in a pool of blood and a shirt wrapped around his chest besides a stretcher.
Under cross examination by A Macaulay of the defense team he tried to establish some inconsistencies of the witness to what he told the court yesterday and the previous statement obtained on the 24/4/09.
Another prosecution witness also testified at the trial and a knife allegedly used by the accused to stab the deceased was tendered to the court and the matter was adjourned for today. By Saidu Bah
