At the Sexual Offences Division of the High Court in Freetown, Presiding Justice Momoh-Jah Stevens on Monday 15th February 2021 discharged two alleged sexual penetrators for want of prosecution.
The two, Morlai Kamara and Sorie Bangura, were charged separately.
According to the prosecution, on 8th September 2019, the accused Morlai Kamara, 47, allegedly sexually penetrated a 12-year-old child.
State prosecutor Jenneh B. Kamara informed the court on Monday that she twice served subpoenas on her witness who has failed to come to court and testify.
The Judge also noted that the accused had been in custody without trial since 2019. Justice Stevens on that note discharged Morlai Kamara for want of prosecution.
The second accused person to be discharged was Sorie Bangura, 33. The allegation against him was that he sexually penetrated a 15-year-old girl on 23rd February 2020.
The Judge took the decision after the defence pleaded with the court for bail for the accused, as there had been no progress in the matter for the past six months.
The Judge after listening to the defence’s submission ordered that the accused be discharged for want of prosecution.
